Acceptance of Terms

By accessing or using the Atria platform at atriashop.me (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Atria ("we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

Description of Service

Atria is an e-commerce analytics and advertising optimization platform. We provide tools for analyzing advertising campaigns across multiple platforms, tracking product performance, accessing creative insights, and generating reports to help merchants and advertisers make data-driven decisions. Our Service targets markets across Latin America and Spain, offering analytics on product trends, advertising competition, and campaign performance.

User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Maintain the security and confidentiality of your login credentials and not share them with third parties.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms.

Acceptable Use Policy

You agree not to use the Service to:

API Data Usage

Our platform integrates with third-party advertising APIs including TikTok Marketing API and Meta Marketing API. Users must comply with the respective platform’s terms of service when using data accessed through our platform. Data obtained through these APIs is used solely for analytics and campaign optimization purposes.

You acknowledge and agree that:

  • Data accessed through third-party APIs is subject to the terms and conditions of those respective platforms.
  • You will not use API-sourced data for purposes that violate the originating platform’s policies, including but not limited to unauthorized data harvesting, user profiling, or discriminatory targeting.
  • We may modify or restrict access to certain API features if required by our third-party data providers.
  • The availability and accuracy of third-party data is dependent on the respective platforms and is not guaranteed by Atria.

Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and underlying code, are the exclusive property of Atria or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent. Any feedback, suggestions, or ideas you provide to us may be used without obligation to you.

Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or applications that are not owned or controlled by Atria. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Atria shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party services. We encourage you to read the terms and privacy policies of any third-party services you interact with through our platform.

Limitation of Liability

To the maximum extent permitted by applicable law, Atria and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Indemnification

You agree to defend, indemnify, and hold harmless Atria, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the Service, your violation of any third-party rights, or any content you submit or transmit through the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts located in Bogota, Colombia, and you hereby consent to the personal jurisdiction and venue of such courts.

Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate formal proceedings. Both parties agree to attempt mediation before pursuing litigation. Any claims or disputes must be brought in the individual capacity of the parties and not as a class action or representative proceeding.

Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least thirty (30) days’ notice prior to the new terms taking effect by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes to the Terms constitutes your acceptance of the new Terms.
